Is combining two sounds regarding a 'derivative work' ?

If I was to take two sounds from this site and combine them together either overlapping or one after the other is that regarded as a derivative work?

What if you put sounds from this site onto a CD and package that with a book or another data cd but do not charge for the sounds CD - in other words say you sell two cd's in one package - one has data on it that you are charging for but the other has the sounds from this site that you do not charge for? Is that legal?

You cannot re-distribute the sounds like that.

But only as part of another work, in a movie, website, music cd etc.

Reading your licence I know

Reading your licence I know it says you cannot "Resell or distribute the sounds 'as they are'" - just trying to clarify is the "distribute" part meaning redistribute commercially - as technically I would not be selling the sound CD and instead be attaching it for free to another CD I am selling.
